Goldblatt + Singer has won a $1.54 million jury verdict on behalf of a man whose skull was cracked by a large tree branch that fell on him while he was waiting at a bus stop.
The man was waiting at a bus stop near the intersection of Jamieson and Pernod Avenues near Lindenwood Park in St. Louis, when a 30-foot branch snapped off of a large pin oak tree and struck him. He sustained a cracked skull and injuries to the entire side of his body as a result.
The city claimed it was not liable for the injuries, but the man’s attorney, Alex Wolff, and his co-counsel, Chris Saracino, argued that the city failed to meet its required tree maintenance ordinances. “The tree that fell on our client had not been inspected for a decade, and was listed as having a defect the last time it was looked at by a member of the city’s forestry department,” said Wolff. At time of publishing, branches of the same tree still hang over Jamieson Avenue.
